Terms and Conditions

Catering:


1. Deposits & Payments


A non-refundable deposit is required to secure any event date.


Your date is not reserved until the deposit is received.


Remaining balances must be paid by the deadline listed on your invoice.


All deposits, partial payments, and full balances are non-refundable.


Payments may be made via credit card, debit card, ACH, or merchant invoice.



Chargebacks & Fraud


Attempted chargebacks for approved, confirmed services (signed or unsigned) will result in:


Immediate cancellation of services


Legal collection efforts


Recovery fees, attorney fees, and administrative fees



We retain the right to dispute chargebacks with banks, processors, and credit agencies.

2. Guest Count & Menu Changes


To maintain product ordering, staffing, and preparation:


Guest count rules


Guest counts cannot be reduced at any time after booking.


Guest counts may be increased (if staff and product availability allow).


Higher guest counts incur additional per-person fees.



Menu changes


Menu changes are not accepted within 7 days of the event.


Premium seafood, steaks, and specialty items may require earlier lock-in (10–14 days).


All changes must be submitted in writing.

3. Allergies & Dietary Restrictions


Client must provide all allergy information in writing before the event.


We accommodate allergies and restrictions when notified early.


We are not responsible for reactions caused by:


undisclosed allergies


cross-contact in third-party venues


guests consuming food not prepared by us



Some foods are prepared in shared kitchens and may contain traces of allergens.

4. Event Timing, Setup, Staffing


We arrive onsite based on your coordination and event timeline.


We provide setup, breakdown, cleanup, and replenishing as listed in your package.


Client must ensure access to the property at the agreed time.

Delays caused by venue access may incur additional charges.

5. Service Location Requirements


Client must provide a safe, accessible environment for:


Staff


Equipment


Food preparation


Transport


Parking



We reserve the right to refuse unsafe conditions (environmental hazards, dangerous guests, violent behaviors, extreme temperatures, etc.).

6. Cancellation Policy


Cancellations at any time result in forfeiture of the deposit.


Cancellations within 14 days of the event require full payment, as food, labor, and prep will already be underway.


No refunds are issued for no-shows, guest count drops, or venue challenges.

7. Photography & Media Release


We may photograph events for marketing unless you request otherwise in writing at least 72 hours before the event.

8. Liability Limitations


Mick’s Kitchen & Catering LLC is not responsible for:


Undisclosed allergies


Guest misconduct or injuries


Venue hazards


Power outages or equipment failure caused by venue conditions


Food removed from temperature control by guests


Weather-related issues


Damages caused by third parties



Our total liability shall not exceed the amount paid for the event.

9. Contract vs. No Contract


These Terms & Conditions apply:

✔️ Without a signed contract

✔️ With digital confirmation

✔️ With a paid deposit

✔️ With an accepted invoice

✔️ With verbal or written approval of services


Any payment made is acceptance of these Terms.

10. Disputes


Any disputes must be submitted in writing.

Disputes related to payments, services, or chargebacks will involve our payment processors, legal counsel, and collection partners.

11. Updates


We may update this Privacy Policy or Terms at any time. Continued use of our services means you accept the updated policies.




Seasoning:

1. Product Usage:


Mom and Mick's Seasonings are intended for culinary purposes only. Keep out of reach of children and store in a cool, dry place.


2. Allergen Disclaimer:


While our seasonings are crafted with care, they are made in a facility that may handle common allergens such as nuts, soy, and gluten. Please review the ingredient list carefully before use.




3. Shipping and Returns:


Orders are processed within 3-5 business days.


Due to the nature of food products, all sales are final. However, if you receive a damaged or defective product, please contact us within 7 days of delivery for a replacement.




4. Liability:


Mom and Mick's is not responsible for improper use, storage, or handling of the product. Always follow the provided storage and usage instructions.




5. Intellectual Property:


All packaging, branding, and designs are the exclusive property of Mom and Mick's. Unauthorized use or reproduction is prohibited.
